These SMS Terms & Conditions ("SMS Terms") govern your use of the SMS and text messaging services provided by Virtual Estimate ("we," "us," "our") through our platform at virtualestimate.ai. By opting in to receive SMS messages from Virtual Estimate, you agree to these SMS Terms in addition to our general Terms of Service and Privacy Policy.

1. Description of SMS Service

Virtual Estimate is a CRM and AI-powered platform designed for the moving industry. Our SMS messaging service allows us to communicate with you regarding:

• Transactional messages: Move estimate confirmations, appointment reminders, job status updates, scheduling notifications, invoice and payment alerts, and account-related communications.
• AI-powered communications: Automated responses generated by our AI system to answer your inquiries, provide moving estimates, and assist with the booking process.
• Promotional messages: Special offers, discounts, service updates, and marketing content related to Virtual Estimate and its partners (only with your separate express written consent).

Our SMS messaging service is powered by Twilio, a third-party communications platform. By opting in, you acknowledge that your messages will be transmitted and processed through Twilio's infrastructure.

2. Consent & Opt-In

By providing your phone number and opting in to receive text messages from Virtual Estimate — whether through our website, CRM portal, quote request form, phone call, or any other method — you are providing your express written consent to receive SMS messages from us at the mobile number you provided.

• Consent to receive SMS messages is not a condition of purchasing any goods or services from Virtual Estimate.
• You may receive an initial confirmation message after opting in, to which you may need to reply to verify your consent (double opt-in).
• By opting in, you confirm that you are the owner or authorized user of the mobile device and phone number provided.
• You must be at least 18 years of age to opt in to our SMS messaging service.

3. Message Frequency

Message frequency varies depending on your interaction with our platform. You may receive messages related to your active move estimates, job updates, appointment reminders, and customer service inquiries. For promotional messaging campaigns, you may receive up to 4 marketing messages per month.

4. Message & Data Rates

Message and data rates may apply. Standard messaging rates from your wireless carrier will apply to all SMS messages sent to and received from Virtual Estimate. We are not responsible for any charges incurred by your mobile carrier. Please contact your wireless provider for details about your text messaging plan.

5. How to Opt Out

After you send the opt-out keyword, you will receive a one-time confirmation message confirming that you have been unsubscribed. After opting out, you will no longer receive SMS messages from us unless you opt in again.

If you wish to re-subscribe, you may text START to our messaging number or re-submit your phone number through our platform.

Please note that opting out of SMS messages does not affect messages sent by other communication channels (e.g., email or push notifications), which are governed by separate preferences.

• We do not sell, rent, or share your phone number or SMS opt-in data with third parties for their own marketing purposes.
• Your information may be shared with our SMS service provider (Twilio) solely for the purpose of delivering messages to you.
• We retain your opt-in consent records and messaging history as required by applicable law and industry guidelines.
• Phone numbers collected for SMS messaging will not be used for any purpose other than as described in these SMS Terms.

Our SMS service is available on all major U.S. wireless carriers, including but not limited to AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and other supported carriers. Carrier support may change without notice. Carriers are not liable for delayed or undelivered messages.

9. Disclaimer of Liability

Virtual Estimate, its affiliates, and Twilio shall not be liable for any delays, failures, or errors in the delivery of any SMS message. We do not guarantee that messages will be delivered successfully to your mobile device, as delivery is subject to your wireless carrier's network conditions, device compatibility, and service availability.

To the extent permitted by applicable law, Virtual Estimate disclaims all liability for any damages or losses arising from the use of or inability to use our SMS messaging service, including but not limited to direct, indirect, incidental, special, or consequential damages.

10. AI-Generated Communications

Some SMS messages you receive from Virtual Estimate may be generated or assisted by artificial intelligence. These messages may include automated responses to your inquiries, AI-generated moving estimates, and automated follow-ups related to your account or service requests.

While we strive for accuracy, AI-generated messages are provided for informational purposes and should not be considered binding offers or professional advice. Final estimates, pricing, and service agreements are subject to human review and confirmation.

11. Messaging Hours

In accordance with the Telephone Consumer Protection Act (TCPA) and applicable state regulations, we will not send non-essential or promotional SMS messages outside of permitted hours. Generally, promotional messages will only be sent between 8:00 AM and 9:00 PM in the recipient's local time zone. Transactional and time-sensitive messages (such as appointment confirmations or urgent job updates) may be sent outside of these hours when necessary.

12. Changes to These Terms

We reserve the right to modify or update these SMS Terms at any time. Any changes will be effective immediately upon posting the revised SMS Terms on our website. Your continued receipt of SMS messages from Virtual Estimate after any changes constitutes your acceptance of the updated terms.

13. Governing Law

These SMS Terms shall be governed by and construed in accordance with the laws of the United States, including the Telephone Consumer Protection Act (TCPA) and guidelines established by the Cellular Telecommunications Industry Association (CTIA), as well as any applicable state laws and regulations governing SMS communications.
